Florida’s HB21 Bill Scheduled To Go Into Effect on JULY 1, 2018

The Florida Legislature has set a limit on the amount of opioids that can be prescribed for the treatment of acute pain. This limit as set in HB21 Bill is scheduled to go into effect on July 1, 2018…

 

The HB21 Bill provides that a prescription for a Schedule II opioid for the treatment of acute pain may not exceed a three-day supply. It does, however, allow for a seven-day supply to be prescribed as long as the prescriber meets each of the following 3 criteria:

 

  1. The prescriber, in his or her professional judgment, believes that more than a 3-day supply is medically necessary to treat the patient’s pain as an acute medical condition;
  2. The prescriber indicates “ACUTE PAIN EXCEPTION” on the prescription; and,
  3. The prescriber adequately documents in the patient’s medical records the acute medical condition and lack of alternative treatment options that justify deviation from the 3-day supply limit.
To enable StreamlineMD’s client prescribing providers to meet the second criteria on the list (indicating “ACUTE PAIN EXCEPTION” on the prescription) with ease and accuracy, we are making enhancements to our StreamlineMD EHR software that will allow our prescribers to document this information quickly and easily. This enhancement should be available in the next 60 days. In the meantime, we are recommending the following steps be taken in the current StreamlineMD software:
  • Through the eRx module: a provider may type in the Pharmacist Note box, “ACUTE PAIN EXCEPTION”.

Important Note: Documentation of the acute medical condition and the lack of an alternative treatment in the medical record is the responsibility of the prescribing provider. It’s important to familiarize yourself with the documentation to fulfill the HB21 requirement mandate.
